Acceptance of terms

By accessing or using ancestralcontext.com (the "Site"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site. These Terms apply to all visitors, subscribers, inquiry submitters, and clients.

These Terms should be read in conjunction with our Privacy Policy, which is incorporated by reference.

Nature of the work

Ancestral Context provides retention strategy consulting and systems work for wellness, beauty, and fashion brands. The Site is a publishing and inquiry platform. Content published here — essays, frameworks, diagnostic tools, and supporting materials — represents the intellectual framework of this practice.

The work described on this Site is advisory and strategic in nature. Nothing here constitutes legal, financial, medical, or regulatory advice. Outcomes from any engagement depend on many factors outside our control, including your market, your product, and your execution. We make no guarantees of specific business results.

Engagements & services

Submitting an inquiry via the Site does not create a client relationship or obligate either party to proceed. A client relationship is established only upon receipt of a written agreement and, where applicable, payment of a deposit or retainer.

Specific terms governing individual engagements — including scope, deliverables, payment, and timelines — are set out in separate engagement agreements. In the event of any conflict between these Terms and an engagement agreement, the engagement agreement governs.

  • Context Audit, Retention Diagnostic, and Systems Work engagements are each governed by a separate written agreement
  • Pricing and scope shared during the inquiry process are indicative and subject to change until an agreement is signed
  • All engagements are conducted asynchronously and delivered in writing unless explicitly agreed otherwise

Intellectual property

All content on this Site — including essays, frameworks, the Modern-Ancestral Continuum™, the Ancestral Context Index™, methodology documentation, visual design, and copy — is the intellectual property of Ancestral Context and is protected by applicable copyright, trademark, and other laws.

What you may do

  • Read and reference essays for personal or professional learning
  • Share links to published essays with appropriate attribution
  • Quote brief passages for commentary or discussion with clear attribution to Ancestral Context

What you may not do

  • Reproduce, republish, or distribute substantial portions of Site content without written permission
  • Use the Ancestral Context Index™ or Continuum framework as the basis for your own commercial offering
  • Remove or obscure any attribution, copyright notice, or branding
  • Scrape, aggregate, or systematically copy Site content by automated means

Frameworks and methodologies developed during an engagement remain the intellectual property of Ancestral Context. Clients receive a license to use engagement deliverables for their internal business purposes. The underlying frameworks may not be commercialized, sublicensed, or presented as the client's own proprietary methodology.

Confidentiality

Information shared during the inquiry and engagement process — including details about your business, retention data, strategy, and operations — is treated as confidential. We do not share client information with other clients or use it to inform work for competitors without explicit written permission.

We may reference the general nature of work done (e.g., "a wellness brand in the supplement space") without identifying details when describing our practice, unless you request otherwise in writing.

Acceptable use

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others. You may not:

  • Attempt to gain unauthorized access to any portion of the Site or its infrastructure
  • Submit false, misleading, or fraudulent information through any form on the Site
  • Use the Site to transmit spam, malware, or unsolicited commercial communications
  • Interfere with or disrupt the integrity or performance of the Site
  • Use automated tools to access, scrape, or interact with the Site without prior written consent

Disclaimers

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Essays, frameworks, and diagnostic tools published on the Site represent our perspective and methodology. They are not guarantees of outcome and should not substitute for professional legal, financial, or medical advice relevant to your specific situation.

The Ancestral Context Index™ is a diagnostic orientation tool. Results reflect how we read the inputs provided and should be interpreted in that context — as a signal, not a definitive assessment.

Limitation of liability

To the fullest extent permitted by applicable law, Ancestral Context and its principal, rey, shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any engagement, including but not limited to lost profits, lost data, or business interruption.

Our total liability in connection with any engagement shall not exceed the fees actually paid by you to Ancestral Context in the three months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify and hold harmless Ancestral Context, its principal, and any affiliated parties from any claims, damages, losses, or expenses — including reasonable legal fees — arising from your use of the Site, your violation of these Terms, or your infringement of any third-party right.

Termination

We reserve the right to terminate or restrict your access to the Site at any time, without notice, for any reason, including but not limited to violation of these Terms. Provisions that by their nature should survive termination — including intellectual property rights, disclaimers, and limitations of liability — shall do so.

Termination of site access does not affect any active engagement governed by a separate agreement. Engagement termination is governed by the terms of the applicable engagement agreement.

Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ancestral Context is registered, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Site shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules, unless both parties agree otherwise in writing.

Changes to these terms

We may update these Terms from time to time. When we do, the "Last Updated" date at the top of this page will change. Material changes will be communicated to active subscribers by email. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

If you have an active engagement, changes to these Terms do not alter the terms of your engagement agreement without your written consent.
